Terms of Service for Bloomtastic App

Effective Date: October 3, 2025

Welcome to Bloomtastic AI (the “App”), operated by HairCoSys Ltd.] (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the App, including any content, functionality, and services offered on or through the App, whether as a guest or a registered user.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App. These Terms apply to all users of the App, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for any activities or actions that occur under your account. We reserve the right to suspend or terminate your account if we suspect unauthorized use or violation of these Terms.

Subscriptions and In-App Purchases

The App offers auto-renewable subscriptions (“Subscriptions”) for premium features, included but not limited to:
- AI Analysis of hair health
- Scalp Condition Detection
- Quantitative Metrics
- Intelligent Product Matching
- Sales Conversion Tool
- Treatment Tracking
- Centralized CRM
- Booking System
Subscription Details:
- Privilege License: Provides unlimited access to all features.
- Duration: Monthly.
- Price (USD or equivalent in local currency):
  - $299.00 USD per month (Professional Version)
  - $209.00 USD per month (Standard Version)
- Subscriptions are billed on a recurring basis and auto-renew at the end of each period unless canceled.
- Prices and terms are subject to change with notice.
Payment: Subscriptions are processed through the App Store (for iOS) or Google Play (for Android). You agree to pay all fees and taxes associated with your Subscription. All payments are non-refundable except as required by law or Apple’s/Google’s policies.
Trial Periods: If offered, free trials convert to paid Subscriptions unless canceled before the trial ends.
Cancellation: You can cancel your Subscription at any time via the App Store or Google Play settings. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided.
Restoration: If you reinstall the App or switch devices, use the “Restore Purchases” feature to regain access to your Subscription, provided you’re signed in with the same store account used for the purchase.

User Conduct

You agree not to use the App for any unlawful purpose or in a way that violates these Terms. Prohibited activities include, but are not limited to:

Uploading harmful content (e.g., viruses, malware).
Harassing or infringing on others’ rights.
Reverse engineering or attempting to extract source code.

We reserve the right to terminate your access for violations.

Intellectual Property

The App and its content (text, graphics, logos, etc.) are owned by us or our licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes. You may not copy, modify, or distribute any part of the App without our written permission.

Disclaimers and Limitation of Liability

The App is provided “as is” without warranties of any kind. We disclaim all warranties, express or implied, including fitness for a particular purpose. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App, even if advised of the possibility. Our total liability shall not exceed the amount you paid for the Subscription in the past 12 months.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms or use of the App.

Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases, but these Terms’ survival provisions remain.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong Special Administrative Region without regard to conflict of laws principles. Any disputes shall be resolved in the courts of Hong Kong Special Administrative Region.

Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.
